The following is a reply from Lyon County Planning Director Rob Loveberg in response to the 9/14/09 NewsDesk commentary relating to the request to change approximately 45 acres on River Road from Low Density Residential to Commercial:
· Actually, the hearing process has not involved an appeal of the Board of Commissioners’ decision. Pursuant to NRS and County Code, the matter of the Master Plan Amendment was referred back to the Planning Commission for a report. The referral is required when the Board of Commissioners’ take an action on a master plan amendment that modifies the action taken by the Planning Commission. In this case, the Board approved the Master Plan Amendment that the Planning Commission denied.
· At its meeting of September 8, 2009, the Planning Commission passed a motion to reaffirm its denial and submit a report to the Board.
· Planning staff prepared the Planning Commission’s report, entitled “Planning Commission Report on Board of Commissioner’s Action,” dated September 21, 2009. On September 22nd the report was emailed to the County Manager’s Office for distribution to the Board of Commissioners. Printed copies were also given to the County Manager’s Office for distribution to the Board.
· The Board is not required to have any additional hearings on the matter.
· The applicant’s have requested that the hearing on their zone change request be held at the Board’s first meeting in November (November 5th) to allow their representative to be present.
· The Planning Department will be submitting an agenda item for the Board’s November 5th agenda for the Board to officially receive the Planning Commission’s report. Again, the Board is not required to have another hearing on the Master Plan Amendment.
· Absent any action by the Board to reconsider their original approval, the Master Plan Amendment will stand as approved and the Board may take action on the requested zone change.
